As one who was very pleased by the selection of Representative Trey Gowdy (R., S.C.) to chair the Benghazi Select Committee, I hate to seem like I'm haranguing him (see, e.g., here and here; but see also here). His investigative decisions, however, continue to be baffling.
The latest development in the Hillary Clinton e-mail saga is the disclosure by her private attorney, David Kendall, that she has deleted all e-mail from the private server on which she improperly conducted government business while she was secretary of state. (See Shannen Coffin's latest legal analysis regarding laws potentially broken by Mrs. Clintonhere.) In light of the obvious ramifications this has for the Benghazi investigation, Fox News's Greta Van Susteren asked Chairman Gowdy what he intended to do about it. Gowdy responded:
We're going to have a conversation with Secretary Clinton.I would hope that it would be a transcribed interview, which is private, it protects her privacy. It protects national-security interests. And it rebuts this notion that this is a political charade, which some Democrats suggest. Let's have a private conversation about why you had your own server, why you didn't return the records when you left the State Department. And why you decided to permanently delete them when you knew the congressional investigations were ongoing.
The Washington Examiner is now reporting that Gowdy's committee has, in fact, "formally requested" that Mrs. Clinton appear for a private, transcribed interview - not compulsory public testimony. It is hard to say what is more disappointing: the chairman's plan or the instincts and apparent motivation behind it...
Efforts by the Obama administration to stem criticism of its diplomacy with Iran have included threats to nations involved in the talks, including U.S. allies, according to Western sources familiar with White House efforts to quell fears it will permit Iran to retain aspects of its nuclear weapons program.
A series of conversations between top American and French officials, including between President Obama and French President Francois Hollande, have seen Americans engage in behavior described as bullying by sources who spoke to the Washington Free Beacon.
The disagreement over France's cautious position in regard to Iran threatens to erode U.S. relations with Paris, sources said.
Tension between Washington and Paris comes amid frustration by other U.S. allies, such as Saudi Arabia and Israel. The White House responded to this criticism by engaging in public campaigns analysts worry will endanger American interests...

How can you be certain the discovery of Obamacare architect Jonathan Gruber's repeated praise for the deception which resulted in the passage of the Affordable Care Act, and his acknowledgement of the "stupidity" of the American people to whom he and his Democratic allies successfully lied, is a major development?The media's response to this revelation.
Not only was Gruber's admission that the ACA was designed to hide its true costs and impact on the American economy already widely known, they say, but that the American public is generally to blame for Gruber's mendacity.
Calling his comments "the impolitic but ultimately unnewsworthy confessions of a single technocrat," The New Republic's Brian Beutler determined that the "finessing" of legislation is a common practice. "It's true that the bill's authors took steps to maximize its public appeal and minimize its vulnerabilities," he noted. "Everyone writing significant legislation does this."
Neil Irwin, writing in The New York Times, concurred that Gruber was essentially lamenting the existence of a system which lead politicians to craft laws that defraud scoring and oversight mechanisms and then brag getting one over on the public. "Mr. Gruber was, in an infelicitous way, expressing frustration with that state of affairs," Irwin charitably explained.
"Jonathan Gruber was right,"The New York Times writer and MSNBC contributor Josh Barro insisted. "Public opinion on health care policy is just completely incoherent." He later insisted that the public's confusion "puts politicians in a position where the only thing they can do to make the public happy is lie and so, people lied."
They hate it when they have to hurt you, so don't make them do it...
The Democratic Senate adjourned without passing any fixes or even voting on any House-passed fixes.
ObamaCare is broken and Democrats will never fix it.

And thus Mary Landrieu unconvincingly joins the swollen ranks of frightened Democrats who are seeking shelter behind awkward equivocations over their own party's leadership, many of whom are trying to deflect attention from long voting records of marching in lockstep when it counts. A vote for Landrieu is a vote for Barack Obama and Harry Reid; the president said so himself. Crossroads GPS is up with a new ad using Obama's infamous interview with Al Sharpton to deny Landrieu the opportunity to open up daylight between herself and the unpopular president she supports 97 percent of the time...
"Why, for example, does the existence of campaign ads constitute a grave danger to the very concept of democracy? After all, a core concept of democracy, especially with respect to free speech, is that the remedy to bad or incorrect speech is not government restriction on speech, but more speech," Red State's Leon Wolf wrote. "When the government plays arbiter between whose speech is protected and whose is not, that is the true threat to Democracy, not the very concept that groups of people who have things they want to say have the money to say them on television."
Wolf puts his finger on the problem: This amendment's supporters sound incoherent because theirs is not a substantive argument. It is merely a populist gripe in the form of legislation. The Democratic Party has come a long way from Al Smith's admonition that "The only cure for the ills of democracy is more democracy." Today, the cure for the ills of democracy is to restrict the freedoms of the Kulak class.
It is the political press which is dropping the ball by not calling this effort out for what it is. That may simply be because, while a kamikaze constitutional amendment may not be the right way to pursue the goal of limiting the influence money has over politics, many agree with that ultimate aim. If, however, the end justifies the means, even if those means are selective honesty and clever omissions while reporting on this particular vehicle, is the end really all that noble and popular?
The conventional wisdom has long held that immigration is the equivalent of Kryptonite for Republicans: If they don't pass comprehensive reform, their party is writing its own extinction. Indeed, GOP officials have been publicly telegraphing their own vulnerabilities on the subject for years, highlighted by a 2013 RNC-commissioned report where immigration was the only policy area where the authors recommended the party moderate its positioning.
But what if that isn't the case? A look at the current politics surrounding immigration suggest that Democrats are facing as much conflicting internal pressures from the current border crisis as Republicans face from their own base when it comes to "amnesty," or legalizing illegal immigrants. President Obama is caught between his base, which has been pushing him to treat the migrants as refugees and settle them in the country, and the majority of voters, who believe that most should be returned to their home countries.
For a long time, immigration has been viewed as a political win-win situation for Democrats, no matter what Republicans did. Block legislation from passing, and Hispanics will never support Republicans again. Support comprehensive reform, and hand the president a political victory without any guarantee it would broaden the GOP's appeal.
But the latest crisis is underscoring that some immigration issues are vulnerabilities for Democrats, too. Most Americans want a secure border and don't back automatic citizenship for anyone seeking to enter the country. It's difficult to find many communities, even liberal-minded ones, that are eager to house busloads of undocumented children. Even O'Malley, the leading champion for the undocumented children, was reportedly reticent about housing them in his state.
Right now, the situation on the border looks chaotic, and that's not a good place for a governing party to be in. And if Republicans can forge a bipartisan solution with more-moderate Democrats, such as Cuellar, by focusing on fixing the problem at hand, they may receive a bigger political boost than by passing comprehensive legislation whose implications most Americans don't fully understand.
